OHIO UNINSURED AND UNDERINSURED ACCIDENT LAWYERS

Injured By an Uninsured or Underinsured Driver?

Drivers in Ohio are required by law to carry minimum liability insurance. Unfortunately, not every driver on Ohio roads adheres to this law. As of 2019, Ohio is ranked 21st in estimated percent of uninsured drivers according to the Insurance Research Council. According to their algorithm, roughly 13 percent of all Ohio motorists are uninsured.

When a driver fails to adhere to traffic laws and causes an accident, they should technically be financially liable for any damages other drivers and passengers suffer. In normal circumstances, their bodily injury liability coverage and property damage liability coverage will pay for those damages.

If they are uninsured or underinsured, they should technically be forced to pay for the damages out of their own pocket. In practice, that’s rarely what actually occurs. As the saying goes, you can’t get blood out of a stone – or in this case money from a driver who can’t even afford car insurance.

These cases can be extremely difficult. The liable driver could potentially have assets you can pursue, like a home, brokerage account, savings, collectibles or other property that can be liquidated. Your best chance of recovering some money from an uninsured driver will be to work with an experienced personal injury attorney who excels at both proving negligence and locating assets.

If you’ve been involved in a crash with an uninsured or underinsured driver, it may be worth your time to request a free consultation with a personal injury lawyer by calling 1-800-411-PAIN.

Is It Worth It to Purchase Uninsured/Underinsured Motorist (UM/UIM) Coverage?

UM/UIM coverage is one of the types of coverage you hopefully won’t need, but if you do ever get into an accident with an uninsured driver, or an accident where your injuries and property damages exceed the other driver’s policy limits, you will be very relieved you have it.

For most drivers, UM/UIM coverage is relatively affordable. If the Insurance Research Council’s algorithm is correct and more than one in ten drivers in Ohio are uninsured, then every accident has a one in ten chance of involving an uninsured driver.

Getting into an accident with an uninsured driver is far from impossible. If you like the peace of mind that comes from knowing you’ll be covered, even if the other driver isn’t, you may want to strongly consider spending a little more on your auto insurance to get the UI/UIM coverage.
