Workers’ Compensation
Whether you work at an office, factory or outdoors, you have the right to a safe work environment. Although most Ohio employers strive to keep their workers safe, not all accidents and injuries on the job can be prevented.
Under Ohio’s workers’ compensation system, if your work-related injury leaves you unable to work for an extended period of time, you’re entitled to medical care and wage replacement benefits.
Is your workplace injury causing you to suffer not only physically but also financially? At the Buckeye Law Group, our workers’ compensation attorneys are here to help you receive the compensation you’re owed while you’re recovering from your injury.
Workers' compensation is insurance that provide benefits to employees who are injured or become ill due to their job. Most traditional Ohio employers are required to carry workers’ comp coverage for their employees.
The Ohio Bureau of Workers' Compensation (BWC) administers the state's workers' compensation system and is one of the largest state-run insurance programs in the country. The BWC provides medical care, wage replacement and other benefits to injured workers and their families. Employers are required to purchase workers' compensation insurance from the BWC or an approved private insurer.
In Ohio, most employers are required to carry workers’ compensation insurance. This means that if you’re injured while performing your job duties, you may be eligible for workers’ compensation benefits. However, there are a few exceptions to this rule.
You’re likely ineligible for workers’ compensation if:
To receive your benefits, you must seek medical attention to protect your health and the integrity of your claim.
You must also report the injury to your employer and then file a claim with the Ohio Bureau of Workers’ Compensation.
Your employer is required to provide you with the necessary forms and information to complete the claim process. The BWC has 28 days to approve or deny your claim based on the information provided by your employer.
In a perfect world, once your workers’ compensation claim is filed, it becomes approved by the BWC within 28 days and you receive the medical and financial benefits you’re owed. However, this isn’t always what happens.
In some scenarios, your claim may be unjustly denied, or you may receive unjustified pushback from the insurance company. If you’re having a difficult time getting your claim approved and receiving the benefits you are rightfully owed, consider hiring a workers’ compensation attorney.
Common scenarios that may necessitate legal counsel and representation include:
Some workers’ compensation claims are straightforward. Others are complicated and more difficult to prove. At the Buckeye Law Group, our workers’ compensation attorneys are here to guide you through this difficult process, overcome any hurdles your employer or insurance company may be throwing your way and help you get the compensation you deserve.
